Vail and USFS in disagreement over “ownership” of Forest Service water rights.

Rights were acquired from the USFS because of the ski area permit.

 

The argument is pretty simple. The ski area claims their own the water rights. The USFS argues the water rights are part of the ski area and the long term sustainability of the ski area is tied to the water rights.

Why we are Here

At the age of seventeen I was ready to throw my life into the daily grind of pulling and stripping wire, crawling in the dark and unpleasant places under the buildings you walk about, simply for a good looking paycheck. It’s not what I wanted to do but I did like the idea of the money and the union aspect of things made it a no brainer. I was on my way to being an electrician. I’d assumed the title of apprentice, I was working in my field in a respectably organization and was close to graduating High School which was the last thing stopping me from fully throwing myself into the trade, when one day that it occurred to me that I really didn’t want to spend my life in that way. I made the conscious decision that I would rather make less money to do something that I have a passion in than make more money doing something I hated. What then fell upon me was the uncertainty of what I could do that I would truly enjoy something that I would be excited to wake up for, BE EXCITED to go to work for.

A short span of time later I found myself poking around the Colorado Mountain College webpage. What happened next could be well explained by anyone who has found their “calling”. When you wake up in the morning knowing “this is what I am supposed to be doing with my life” it was so obvious. Ski Area Operations. Those three words made my mind explode with ideas, possibilities, opportunities and excitement for the new mountains I would get to explore and learn, people to meet and friends to make. To say the least I was a kid in the Costco of candy stores.

It does not take one long to know when you are in common company even more so here in Leadville. When you begin talking with people you have never met or seen and you instantly spark a conversation that hits home and you realize the passion that brought you here is instilled in your classmates that everything that attracted you to this school attracted them in more or less a similar way. We are here for the lifestyle. We are here for the passion, the booters, thrills, a good time and most of all those bluebird powder days where you can hardly breathe from all the snow being hurtled into your face. The people you meet and the friendships you forge. This is why we are here, because nothing on earth makes us feel the way we do while riding down the side of a mountain, nothing gets us going more than hoping in that car on our way to ride what will go down as one of our greatest pow days ever. Daron Rahlves is New Ambassador for Learn to Ski and Snowboard Month


Daron Rahlves is New Ambassador for Learn to Ski and Snowboard Month
LAKEWOOD, Co. (October 31, 2011) - World champion skier, Daron Rahlves is the latest Ambassador for Learn to Ski and Snowboard Month (LSSM), the national initiative that encourages children and adults to get involved with skiing and snowboarding by taking lessons from professional instructors. Rahlves serves as ambassador for Sugar Bowl Resort in Norden, California, near Lake Tahoe. He works with the ski academy and ski team sharing his knowledge from his ski racing success. He retired from racing in 2006 and recently was inducted into the U.S. Ski and Snowboard Hall of Fame along with the first LSSM Ambassador, Glen Plake. Olympic Gold Medalist Bode Miller is also a LSSM Ambassador. 

"I'm excited to be an Ambassador for Learn to Ski and Snowboard Month. Skiing is an amazing feeling and a great way to connect to the mountains. I've done it my entire life with family and friends and it's a huge part of me," said Rahlves. "My passion for snow sports is strong and I encourage others to try, especially kids because it's a fun adventure and a great activity for the whole family. Once you ski or snowboard down a mountain, your life will change.  I see it in the eyes of my young twins and everyone else out on the snow."
As a racer, Rahlves won 12 World Cup races, stood on the World Cup podium 28 times and took seven U.S. National titles. He is the only American to win the legendary Hahnenkamm in Downhill and Giant Slalom. In 2001, Rahlves was the World Champion in Super G. He was named to five World Championships teams and four Winter Olympics teams.   

Born in Walnut Creek, California, Rahlves was exposed to all kinds of sports including soccer, tennis, golf, waterskiing, jet skiing, motocross, and skiing. Growing up, he spent every winter in Tahoe and summers at Clear Lake, skiing and participating in water sports.

 "We are so pleased to have Daron and Sugar Bowl involved with this initiative," said Raelene Davis, chair of the LSSM task force. "He is the epitome of the all around elite athlete and recreation enthusiast who can set a good example for involvement in winter sports and activity year-round."

Forgetting your beacon is manslaughter in Europe….if you wife dies in an Avalanche

Verdict confuses everyone

In what many are calling a crazy decision, a man has been found guilty of manslaughter and sentenced to three months of prison, suspended for allowing his wife to ski without an avalanche beacon.

The slide occurred on a 35° slope the risk was given as Considerable (3/5). The lack of beacon seriously delayed finding the victim even when rescue services arrived on the scene. The 58 year old woman had suffered from serious head injuries after being buried over a meter in dense snow.
Because the woman was not wearing a beacon the rescue took a considerable amount of time.
The deicison has left many people very confused in Austria.
Michael Larcher, director of education of the Austrian Alpine Association has questioned the verdict. He points out that although the woman was less experienced than her husband they had been touring together for years, “she was no beginner but had enough personal knowledge to know to turn on her beacon. Given that the lack of beacon was the main reason for the verdict, in my opinion, you cannot put all the responsibility on the husband, it is an issue of personal responsibility”.
Estolf Müller, representing the Austrian Mountain Rescue Service said that “judging who is experienced is legally very difficult, I’m really sceptical when the courts intervene in a private sport so long as innocent bystanders are not endangered. When you go into the backcountry everyone has to be responsible for themselves.”

So?

The man in this case may also be facing a civil suit by the family on top of losing his wife. Personally, I think this is a little extreme. However it points out the differences between the United States and Europe.
Most European countries are based on a criminal system to enforce the standards of care. If you do not take care of someone you face jail time.

In the US we rely on a civil litigation system. If you do not take care of someone you face a lawsuit. Only in extreme cases where your actions are so bad or intentional can you face losing your freedom in the US. I show it visually this way.

The Red Column is the amount of proof needed to convict in a Criminal Case. The Blue Column is the amount of proof needed to win a civil case.

The US is based on a system that personal freedom is important and society, not the government should decide when someone has injured another. In Europe, the government is in charge of deciding the wrongs and rights of all of society.
